BLOOD TESTS

Borrelli Law backgrounds.png

Blood test laws in the United States primarily relate to their use in medical, legal, and employment contexts, with a significant focus on DUI (Driving Under the Influence) scenarios. Generally, law enforcement can require a blood test if there's probable cause of intoxication, but consent is often needed except in cases where implied consent laws apply, which can lead to license suspension for refusal. Privacy laws and the Fourth Amendment protect against unreasonable searches, so blood tests usually require either a warrant, consent, or an exigent circumstance. In employment settings, mandatory drug testing including blood tests must comply with federal and state laws that might require reasonable suspicion or a specific policy. Medical blood tests are governed by HIPAA for privacy and consent. The admissibility of blood test results in court can depend on how the sample was collected, stored, and analyzed, emphasizing the importance of proper legal procedures.
