Prenuptial agreement disputes in the U.S. are governed by state law, making each case potentially unique, but common issues revolve around the agreement's validity, fairness, and enforcement. A prenup might be challenged on grounds like inadequate disclosure of assets, one party signing under duress or without understanding the agreement, or if the terms are deemed unconscionably unfair. Courts often assess whether the agreement was entered into voluntarily and with full knowledge, if there was fair and reasonable disclosure of property and financial obligations, and if it does not promote divorce. If a prenup is contested, the validity can hinge on these factors, potentially leading to the agreement being upheld, modified, or voided, affecting asset division, spousal support, and other marital rights upon divorce.
